Revised fed. regulations could make Florida gaming compact a reality

In the Sunshine State, a few sentences inside a huge packet of legislation could have significant ramifications on the future of sports betting in Florida. Per one report from earlier this month, a proposed federal rule could change everything for Indian gaming. Moreover, this revised regulation, if seen through, could make the Florida Seminole compact “legal” and expand other tribes’ access to digital gaming. Within this significant pocket of proposed updates to federal regulation lies several sentences that could alter the face of digital gaming in Florida. Proposed rules could provide for tribal online gaming

According to this article, the latest proposed rules would allow tribes to purchase land, put in a trust, build casinos, and then provide the same types of online gaming. The added caveat here is that they would also be taxed by the state on those lands. Additionally, one source says this could prove to be the biggest shift in gambling since the Professional and Amateur Sports Protection Act was overturned in 2018. Moreover, when the Supreme Court rejected PASPA, it made the legalization of sports betting a states’ rights issue. That said, the proposed update includes at least three major changes. 

According to one outlet, of the proposed changes, tribes could offer sports betting throughout the state within which they are located. Additionally, states that do not currently have a form of legal Class III gambling likely would have to negotiate each Class III license with tribes. In today’s gaming landscape, “all” forms of Class III gaming may be negotiated through compacting and potentially include digital betting. Finally, tribes would be permitted to purchase new land but would need to through a formal process to be available to gamble on under IGRA. 

Sources see this as being an all-encompassing solution

One anonymous source in the report, an attorney who specializes in tribal gaming law, said this new regulation change could fix a lot of current sports betting issues. According to this report, the Indian Gaming Regulatory Act (IGRA) “only governs on tribal lands, so this appears to be intended to fix that lawsuit.” says one source. If these new regulatory changes go through though, it likely would permit them to offer wagering off reservations under the compact they negotiated with the state of Florida. Moreover, per the source, tribes could possibly offer mobile gaming throughout the state without a commercial license. This also means those proposed rule changes could be challenging procedurally and for substantive grounds.
